Status Update | May 29, 2026
Just a quick status update on our efforts to oppose the Board’s recent court actions. Thanks to the efforts from many of you and our tireless canvassers, we have successfully collected 289 written objections to date from HOA owners, with more continuing to trickle in. This corresponds to 41% of the GCA’s members, thereby exceeding the 33% minimum required by C.R.S. 38-33.3-217(7) for defeating the Board’s petition.
Per civil proceedings, we have informed the Board’s lawyers of our intent to file the objections on June 2nd and asked if - given that we have enough objections to defeat it - they would withdraw their petition. Unfortunately, we have been told that the Board has declined that suggestion and wants to move on to a court hearing. So...I guess we will be participating in a court hearing at 8:30am on June 9th in El Paso County Court Division 17, room S503. There is a chance that this date could be pushed back as we have a pending motion for extension - frankly, we had originally expected it to take longer to collect signatures! I’ll update the list with any changes.
I am not a lawyer, but for cost containment reasons will be representing the objections at the hearing against the Board’s attorneys. Nobody is required to attend - I’m filing the objections as a block, and so I can/will represent them collectively. However, you are of course welcome to attend as a member of the audience for any civil court proceeding. Please know I will do my best to represent our objections.
Note that we will continue to collect signed objections until the hearing. Always good to send a stronger message to deter future repeats of this situation.
Meantime, a group of us have begun collecting thoughts and suggestions contributed by many of you and provided during the frequent discussions we had while collecting signatures. We are putting those together to identify areas that need addressing and assemble some coherent suggestions on a path forward. We clearly need to restore confidence in the HOA and make it an organization where people feel included. As we come up with ideas, we’ll circulate them and begin building communication channels to incorporate your input and collectively move forward.
